Oops . Looks like Apple is facing another grade action suit .
The suit revolves around a clause in the AppleCare contract that suppose that replacement gadget you get when you break your gadget will be “ equivalent to new in performance and reliability . ” The pillow slip rests on what the definition of “ tantamount to new in execution and dependability , ” and whether refurbished devices settle into that category .
The plaintiff , Vicky Maldonado , received refurbished devices double under two different AppleCare Plus plans . She exact that when she brought her broken fourth generation refurbish iPad to the Genius Bar , Apple replaced it with another renovate iPad . She alleges that the replacement machine was not “ new or tantamount to new in performance and reliability ” although judicature papers do n’t say exactly what was untimely with the iPad she receive .

AppleInsidertalkedto someone who ferment at the Genius Bar who severalise them that when they swap out your iPhone on the post , Apple does generally give you a machine that is “ refurbished , and functionally equivalent to new . ”
TBH , this suit sound incredibly petty and I love it . I care get novel things well than sometime thing too .
